Lawyers stated Pike’s elevated platelet levels could see her potentially develop a dangerous fluid buildup in her lungs during execution by lethal injection.
They wrote, “A pulmonary edema is not simply painful or uncomfortable; it can create a sense of suffocating or drowning that has been likened by experts to the sensation intentionally induced by the practice of waterboarding—an unambiguous form of outright torture.”
The complaint also reportedly highlighted problems with Pike’s veins, including: “A history of difficulty with blood draws and needle insertion.”

Lawyers reportedly noted in the complaint that prison medical staff use ʙuттerfly needles to draw blood, which they said, “is a feasible and readily implemented alternative that significantly reduces the substantial risk of unnecessary pain and suffering posed.”
They are understood to have complained of a recently updated Tennessee execution protocol which they said, “fails to provide counsel with immediate access to a telephone before and during the execution.”
According to her lawyers, during Pike’s botched execution prison staff struggled for a long period to establish IV lines before she survived two doses of pentobarbital.
The Tennessee Department of Correction stated it followed protocol during the execution attempt.

She was hospitalised for more than a week and was moved to the Debra K. Johnson Rehabilitation Center, where she is currently in maximum security confinement.
Tennessee Governor Bill Lee suspended executions for the rest of the year following Pike’s failed execution.
Pike was sentenced to death for the 1995 murder of Colleen Slemmer, 19, which she committed at 18 with her then-boyfriend Tadaryl Shipp.
Prosecutors argued at trial that they lured Slemmer to a wooded area and killed her.
Because Shipp was 17 at the time of the killing, below the eligible age for the death penalty, he was handed a life sentence instead.
Shipp is currently incarcerated at the Northwest Correctional Complex in Tennessee, having most recently been denied parole in October 2025.
